All rights reserved.** --- ## Preamble This software — the Global Graviton Gauntlet (#GGG) sovereign edge daemon, its local data vault, loopback API gateway, and associated tooling ("the Software") — is **source-available, not open source** under OSI definitions. It is engineered around a single non-negotiable principle: **the person running the hardware owns the computation, the data, and the keys.** This license grants broad, permanent, royalty-free rights to individuals while reserving commercial exploitation for negotiated license. Read it carefully — it is short because it does not hide anything. --- ## 1. Definitions - **"You"** — the individual or legal entity exercising rights under this license. - **"Individual Use"** — use by a natural person on hardware they personally own or control, for personal, hobbyist, educational, or academic research purposes. - **"Commercial Use"** — any use of the Software, in whole or in part, that is intended for or directed toward commercial advantage or monetary compensation, including but not limited to: - bundling the Software into a product, service, operating system, browser, cloud marketplace offering, or SaaS/PaaS/IaaS tier that is sold or monetized; - deploying the Software across a fleet of devices owned or operated by a corporation, government prime contractor, or other legal entity in production; - embedding the Software into hardware (routers, edge servers, NPU/GPU appliances) that is manufactured, sold, or leased; - using the Software internally to process, store, or serve data as part of a paid service or revenue-generating operation. - **"Academic Research Use"** — use by students, faculty, or researchers at an accredited institution for non-commercial study, teaching, or publication, including use within grant-funded research where the results are published openly and no product or service is sold. ## 2. Grant for Individual and Academic Use Subject to the conditions below, Garza Global Graviton LLC hereby grants You a **perpetual, worldwide, royalty-free, non-exclusive, non-transferable** license to: 1. **Run** the Software on hardware You own or control; 2. **Audit, inspect, and study** the complete source code; 3. **Modify** the Software for Your own Individual or Academic Research Use; 4. **Own locally** — the Software, its outputs, and all data it processes remain Yours, on Your machine, forever; 5. **Share unmodified copies** of the Software with other individuals, provided this license is included intact and no fee is charged. These rights are **free as in beer and free as in audit** — no account, no activation, no telemetry handshake, no feature gating. ## 3. Commercial Use Requires a Signed License **Commercial Use is not permitted under this license.** Any Commercial Use requires a separate, signed commercial agreement with Garza Global Graviton LLC. This is not a barrier — it is a doorway. We actively welcome OEM embedding, cloud marketplace distribution, and hardware fleet licensing, and offer three standard commercial pathways (OEM Technology License, Cloud Edge Program, and Hardware & Network Alliance) with published entry pricing. See [ENTERPRISE_PARTNERSHIPS.md](ENTERPRISE_PARTNERSHIPS.md) or contact **partners@garzaglobalgraviton.com**. ### 3.1 What stays free, forever - Personal and hobbyist use, including on a home server or homelab cluster. - Academic research and classroom use, including thesis and publication work. - Security auditing, benchmarking, and publishing findings (we ask — but do not require — coordinated disclosure for vulnerabilities). - Running a single node for a non-monetized community project. ### 3.2 What requires a commercial license - Shipping the Software inside any product or paid service. - Production deployment across corporate or government fleets. - Factory-flashing onto hardware offered for sale or lease. - Reselling, sublicensing, or rebranding the Software or its daemon binaries. ## 4. Conditions on All Use 1. **No removal of notices.** Copyright, license, and attribution notices must be preserved in all copies and substantial portions. 2. **No telemetry injection.** Modified versions distributed to others must not add tracking, analytics, or phone-home behavior without the explicit, informed consent of the end user, disclosed in the modified source. 3. **No misrepresentation.** You may not claim that modified versions are authored, endorsed, or certified by Garza Global Graviton LLC. 4. **License propagation.** Every redistribution, modified or not, must include this license text. ## 5. Data Ownership (Absolute) All data processed, stored, indexed, sealed, or exported by the Software belongs exclusively to the operator of the hardware on which it runs. Garza Global Graviton LLC claims **no rights whatsoever** over Your data, Your models' local outputs, or Your vault contents. The Software contains no mechanism by which we could access them — this is verifiable in the source. ## 6. Termination Individual rights under Section 2 terminate automatically upon material breach, but are reinstated upon cure within 30 days of notice. Termination never revokes Your ownership of Your own data or Your right to export it from the vault. ## 7. No Warranty; Limitation of Liability THE SOFTWARE IS PROVIDED "AS IS", WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NONINFRINGEMENT. IN NO EVENT SHALL GARZA GLOBAL GRAVITON LLC BE LIABLE FOR ANY CLAIM, DAMAGES, OR OTHER LIABILITY ARISING FROM THE SOFTWARE OR ITS USE. ## 8. Governing Text This is the entire agreement for Individual and Academic Use. If any provision is held unenforceable, the remainder stays in force.
